New Rules: Florida Officials Must Cite Code
This episode focuses on new statutes effective from July 1, 2023, aiming to prevent local building and fire safety officials in Florida from imposing unwarranted requirements after issuing a permit. Building officials are now required to identify specific codes being violated under the new 553.79(2)(a)(1) statute. A failure to do so may result in disciplinary action against their state-issued certificate. Similarly, fire safety officials must also identify specific code violations according to the 633.208 statute. This legislation is a response to officials mandating changes post-permit without providing a basis for the alteration. Both laws necessitate officials to identify specific code chapters and sections, and provide this information to the permit holder in writing.
