Keep an Eye Out for Hidden Conditions in Construction Contracts
A contractor may encounter conditions during the course of work that were not anticipated. These can include unforeseen subsurface conditions, changes in local ordinances, or unanticipated costs. For example, if an excavation collapses because it was improperly prepared, the owner would be liable for the cost of repairing or replacing the collapse. In order to avoid being held responsible for expenses incurred due to unforeseen conditions, contractors should carefully review their contracts for hidden conditions before bidding on them.
